According to the RIA Novosti news agency, the collegium of the Supreme Court on cases of administrative offenses outlined a situation where a drunk motorist has the right to be in a vehicle. According to the decree, drunken citizens can sit behind the wheel of a car while parked with the engine turned off.
The Supreme Court considered the complaint of a motorist who was deprived of his license for almost two years, and also fined 30,000 rubles for driving while intoxicated. On appeal, the driver said that he was indeed drunk at the wheel, but the car was parked on the side of the road with the engine turned off. This version was confirmed by witnesses, as well as a traffic police officer.
The judge ruled that the control of the vehicle should be considered the deliberate impact of the driver on it, as a result of which the car moves in space. In this situation, the car was at rest, so the court decided to terminate the proceedings against the motorist.
At the end of July, a resident of the Moscow region was deprived of a driver’s license for drunken riding on an electric scooter. In addition, the man was fined 30,000 rubles.
